Unable to use DSL connection in shared flat. Is early termination possible?
vor 12 Stunden
Hello Telekom Community,
I am currently living in a shared apartment (WG) with two other roommates. Before I signed the Telekom DSL contract, we agreed that we would share the internet costs equally. Based on that agreement, I registered the internet contract under my name and the monthly payment is taken from my bank account. However, after a few months my roommates stopped paying their share of the internet costs, which has already created a financial problem for me. There is also another issue. The apartment has only one DSL socket, and it is located in one of my roommate’s rooms. The DSL cable that connects to my modem must come from that room.
Recently, this roommate told me that he no longer allows the DSL cable to be connected through his room. He does not allow the cable to stay connected to the socket and also does not allow the cable to come out of his room anymore. As a result, I currently do not have access to the internet connection, even though the contract is still active and I am still paying for it.
My question is: Given this situation, is it possible to cancel my Telekom contract earlier than the minimum contract period? Although the contract is under my name, I currently no longer have access to the DSL socket in the apartment, so I cannot use the internet service at all. Thank you for your help.

Hi @0:0,
I am sorry regarding your situation unfortunately that is not a sufficient reason to cancel your contract earlier. The connection is technically viable.
Maybe you can reason with your roommates. I wish you luck with that.
Kind regards

Hello,
thanks for your reply. I understand that the connection is technically available at the address, but the problem in my case is that I no longer have physical access to the DSL socket. In our WG each person lives in one private room. The only DSL socket in the apartment is inside one roommate’s room. The DSL cable to my modem has to pass through that room. This roommate now refuses to allow the cable to stay connected or pass through his room, so I cannot access the DSL socket anymore and cannot use the internet at all, even though the contract is still active. I also contacted the landlord about this, but she said this issue between roommates is not her responsibility. So technically the line may exist, but in practice I cannot use the service.
Because of that I would like to ask if an außerordentliche Kündigung might be possible.
Reasons:
no physical access to the DSL socket
permanent impossibility to use the service
situation outside of my control
Possible legal basis:
§314 BGB – außerordentliche Kündigung aus wichtigem Grund
§275 BGB – Unmöglichkeit der Nutzung der Leistung
§313 BGB – Störung der Geschäftsgrundlage
Kind regards.

Consider to involve your landlord. Especially if your rental agreement mentions the ability to use DSL or a landline phone.
