Kidswatch TCL Move Abhörfunktion

Hallo alle zusammen,

es geht um die Kidswatch von TLC von der Telekom. Meine Nichte hat diese Uhr und laut Gesetz dürfen Smart Watches mit Abhörfunktion diese in der Schule nicht benutzt werden. Ich finde allerdings nirgends etwas darüber, dass diese Uhr keine Abhörfunktion hat. Hat die Uhr jetzt eine oder nicht? Und wenn nicht, könnte man irgendwas offizielles gepostet werden, was man der Schule vorlegen kann? Vielen lieben Dank schon mal vorab.

      Hätte sie eine, so würde es auf der Produktbeschreibung stehen.
      Schließlich ist das ein Super Werbemittel.

      Das fehlen der Information in der Produtkbeschreibung sagt also, dass sie so eine Funktion nicht hat.
      Da muss daher auch nichts geschrieben werden.

      Hallo @Efacsen,

       

      solche Uhren dürfen nicht nur in Schulen, sondern seit 2017 in der ganzen BRD weder verkauft, betrieben noch nicht einmal besessen werden. Siehe TKG §90.

      Ich verstehe des Gesetzestext etwas anders. Zitat:...die ihrer Form nach einen anderen Gegenstand vortäuschen oder die mit Gegenständen des täglichen Gebrauchs verkleidet sind und auf Grund dieser Umstände oder auf Grund ihrer Funktionsweise in besonderer Weise geeignet und dazu bestimmt sind, das nicht öffentlich gesprochene Wort eines anderen von diesem unbemerkt abzuhören...(Zitatende)

      Nun täuscht die Kidswatch ja nix vor. Sie wurde vielmehr extra dafür hergestellt, um in Verbindung mit den Eltern zu bleiben.

      Wenn man in deiner Interpretation weiterdenkt, dürften Handys auch nicht mehr betrieben werden. Schliesslich kann ich auch mit diesen unbemerkt jemanden abhören.

      Dass sie in der Schule nicht betrieben werden dürfen, hat so erstmal nichts mit dem TKG zu tun. Es liegt hier vielmehr am Hausrecht der Schule, um z.B. Betrügereien/Schummeln bei z.B. Leistungskontrollen gleich im Vorfeld zu unterbinden.

      Was Du darunter verstehst, ist nicht relevant.
